“Article 370” A Controversy or Reality

The lead character in the upcoming action-packed political drama is played by Yami Gautam. Jio Studios surprised fans on Instagram recently with a teaser video. In the trailer, Yami was shown fighting corruption and terrorism in Kashmir with a strong visage. Under the direction of Aditya Suhas Jambhale, Article 370 is set to provide a gripping story and thrilling experience, featuring some amazing performances. Priyamani is also a star of the film. The teaser, which is set against the fascinating backdrop of Article 370, provides a tense look into the private series of events and the extraordinary circumstances that resulted in the unique and historic decision to declare Article 370 ineffective. On February 23, the movie is scheduled for release in theaters all around the world.

This film is based on the 2019 repeal of Article 370. The term “article 370” refers to Article 370 of the Indian Constitution, which granted Jammu and Kashmir, a region in the country’s north and a portion of the broader area of Kashmir that has been the focus of conflict between China, Pakistan, and India since 1947, special status. From November 17, 1952, until October 31, 2019, Jammu and Kashmir was governed by India as a state. It was granted autonomy over its internal affairs, a distinct constitution, and a state flag under Article 370.

The 1954 Presidential Order was issued based on the recommendations made by the state constituent assembly, which was constituted with the aim of determining which articles of the Indian constitution should be applicable to the state. Article 370 was considered to have been a permanent part of the Indian Constitution as the state constituent assembly dissolved itself without proposing its repeal.

The Indian government promulgated a Presidential decree on August 5, 2019, which replaced the 1954 decree and extended to Jammu and Kashmir all the articles of the Indian constitution. The resolution approved by a two-thirds majority in both chambers of the Indian parliament served as the basis for the order. On August 6, another order rendered all of Article 370’s clauses null and void, with the exception of clause 1. Furthermore, the parliament enacted the Jammu and Kashmir Reorganisation Act, 2019 which established the division of the state of Jammu and Kashmir into two union territories, which would be known as the Union Territory of Ladakh and the Union Territory of Jammu and Kashmir. The date of the reorganization was October 31, 2019.

The Supreme Court of India received 23 petitions contesting the validity of the repeal of Article 370 of the Constitution, forming a five-judge panel to hear the cases. A five-judge constitution panel unanimously affirmed the validity of the repeal of Article 370 of the Constitution on December 11, 2023.
